Waiver & Release of Liability

Please read carefully. By checking the agreement box during player registration on Zeffy, you confirm that you have read, understood, and agree to all terms below. This waiver is legally binding.

In consideration of being allowed to participate in any way in MapleNet Catchball League's athletic sports program, related events and activities, the undersigned acknowledges, appreciates, represents and agrees that:

The risk of injury from the activities involved in this program is significant, including, without limitation, the potential for falling, slipping, colliding with others, tripping, being hit by a thrown ball, temporary and permanent injury to limb and life, injury to internal organs and soft tissues, injury to fetus and/or pregnancy, and permanent paralysis and death. Although particular rules, equipment, and personal discipline may reduce this risk, this risk does exist and cannot be completely mitigated; and,

KNOWING AND FULLY APPRECIATING THE EXISTENCE OF THIS RISK, I KNOWINGLY AND FREELY ASSUME ALL SUCH RISK(S), both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES (defined below) or others, and assume full responsibility for and the risk of my participation; and,

I willingly agree to comply with the stated and customary terms and conditions for participation. If, however, I observe any unusual significant hazard during my presence or participation, I will immediately remove myself from participation and immediately bring such unusual significant hazard to the attention of the nearest immediate official; and

I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS MapleNet Catchball League, its officers, directors, officials, agents, coaches, attorneys, volunteers, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event ("RELEASEES"), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, loss of income, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.

This Release and Waiver extends to any and all claims I have or may have against the RELEASEES whether such claims result from negligence on the part of any or all RELEASEES with respect to this event or with respect to the conditions, qualifications, instructions or procedures under which this event is conducted or from any other cause.

I understand that my execution of this Release and Waiver means that I agree not to sue any or all of the RELEASEES for any injuries resulting to myself, my guests I invite or bring to the Activity, or my property during or in connection with the Activity. In signing this Release and Waiver, and in participating in or attending the Activity, I represent that I am fully knowledgeable of the danger and hazards associated with the participation and viewing of the Activity, and have assumed all such risks, dangers and hazards. I understand that participating in and/or attending the Activity may cause or result in serious temporary or permanent injury or death.

I certify that I am medically fit and competent to participate in the Activity, and assume the risks of participating in the Activity. I am voluntarily participating in the Activity and I expressly agree to assume the entire risk of any personal injury, including death, which I might suffer as a result of my participation in the Activity, whether such risk results from negligence on the part of any or all of the RELEASEES.

I certify that I am not under the influence of any narcotic, alcohol or other drug that may impair my understanding or judgment, and that I will not at any time during the event play under the influence of any narcotic, alcohol or any drug.

I HAVE READ THIS WAIVER AND RELEASE OF LIABILITY AGREEMENT, AM OF SOUND MENTAL CAPABILITY, OF THE AGE OF LEGAL CONSENT, AND FULLY UNDERSTAND ITS TERMS, AND UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY AGREEING TO IT, AND DO SO FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, UNDUE INFLUENCE OR RESERVATION, AND INTEND MY AGREEMENT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY THE LAW.
