BY SUBMITTING THIS FORM, YOU WILL WAIVE CERTAIN LEGAL RIGHTS. PLEASE READ CAREFULLY.
I, the participant, acknowledge and agree that in consideration of being permitted to participate in the Aurora Catchball Games / Practices, Program and related Activities arranged, organized, sponsored, conducted, authorized, staged and/or operated by MapleNet Catchball League.
1. I, the Participant, HEREBY ACKNOWLEDGE AND AGREE THAT:
I understand, acknowledge and assume the inherent risks in participating in the Aurora Catchball Games / Practices and related activities, including, but not limited to: the potential for bodily injury or illness (including contraction of COVID-19); contact or interaction with others who may have been exposed to COVID-19; permanent disability, paralysis, or loss of life; collision with natural or manmade objects; dangers arising from adverse weather conditions; imperfect venue or field of play conditions; equipment failure; participants of varying skill levels; inadequate safety measures; circumstances known, unknown or beyond the control of the Organizer, its partners, sponsors, agents, affiliates, directors, employees, officers, therapists, or volunteers (together, the "Organization"); negligence or omission of the Organization (collectively, the "Risks").
In consideration for allowing the Participant to participate in the Aurora Catchball Games / Practices and related activities, the Participant:
(a) releases, discharges and forever holds harmless the Organization from any and all liability for damages or loss arising as a result of the Risks of participation in or in connection with the Aurora Catchball Games / Practices and related activities;
(b) waives any right to sue the Organization in respect of all causes of action (including for injuries or illness caused by their own negligence), claims, demands, damages or losses of any kind that may arise as a result of the Risks of participation in or in connection with the Aurora Catchball Games / Practices and related activities; and
(c) freely assumes all risks associated with the Risks, anything incidental to the Risks, which may arise as a result of participation in or in connection with the Aurora Catchball Games / Practices and related activities.
YOU ARE GIVING UP LEGAL RIGHTS TO ANY AND ALL FUTURE CLAIMS AGAINST THE ORGANIZATION.
I hereby assume all of the risks of participating in any Aurora Catchball Games / Practices or Activity. I certify that I am physically, emotionally and mentally fit and have not been advised otherwise by a qualified medical professional. I willingly agree to comply with the customary terms and conditions for participation.
I understand that MapleNet Catchball League does not undertake to provide health, accident, disability, hospitalization, personal property, or other insurance for participants. I affirm that I have appropriate medical insurance in the event medical attention is needed.
I understand that I may be photographed and agree to allow my photo, video, or film likeness to be used for any legitimate purpose by MapleNet Catchball League, including on social media and promotional materials.
I hereby consent to receive emergency medical treatment that may be deemed advisable by a medical professional in the event of injury, accident, and/or illness during any Aurora Catchball Games / Practices or Activity.
2. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, hereby to the greatest extent permitted by law, RELEASE, HOLD HARMLESS AND INDEMNIFY MapleNet Catchball League and its directors, officers, employees, volunteers, sponsors, independent contractors and agents (collectively "the Released Parties") from all liability, and all recourses, proceedings, claims, and causes of action of any kind whatsoever, present or in the future, in respect of any and all personal injuries or property losses which I may suffer arising out of or connected with travelling to and from or my preparation for, or participation in Aurora Catchball Games / Practices or Activities.
3. Governing Law
This Agreement shall be construed, interpreted, and enforced in accordance with the laws of the Province of Ontario, Canada.
4. Code of Conduct
a. All participants must be a positive role model and encourage sportsmanship by showing respect and courtesy to all players, coaches, officials, staff, and volunteers.
b. Participants shall not engage in any disrespectful or unsportsmanlike conduct.
c. Participants must not engage in any sexual, abusive, unwelcoming or inappropriate activity.
d. The taking of recreational drugs and/or alcohol is strictly prohibited.
e. Participants must not engage in any illegal activity.
