Waiver & Release of Liability

Please read carefully and sign below. All participants must complete this waiver before taking part in the event. By submitting this form, you confirm that you have read, understood, and agree to all terms below.

I, the participant, acknowledge and agree that in consideration of being permitted to participate in the MapleNet Free Season Kickoff, related activities, and events arranged, organized, sponsored, conducted, authorized, staged and/or operated by MapleNet Catchball League:

1. ACKNOWLEDGMENT OF RISK

I understand, acknowledge, and assume the inherent risks in participating in the Season Kickoff and related activities, including, but not limited to: the potential for bodily injury or illness (including contraction of communicable disease); contact or interaction with others who may have been exposed to communicable illness; permanent disability, paralysis, or loss of life; falling, slipping, colliding with others, being hit by a thrown ball, injury to internal organs and soft tissues, injury to fetus and/or pregnancy; actions of other participants, volunteers, spectators, coaches, and event officials; lack of hydration; dangers arising from adverse weather conditions; imperfect venue or field of play conditions; equipment failure; participants of varying skill levels; inadequate safety measures; and circumstances known, unknown or beyond the control of the Organizer, its partners, sponsors, agents, affiliates, directors, employees, officers, therapists, or volunteers (together, the "Organization"); and negligence or omission of the Organization (collectively, the "Risks").

The Season Kickoff and related activities — including travelling to or from the event and preparation for participation — can be a significant physical test and carries with it the potential for death, serious injury, and property loss.

KNOWING AND FULLY APPRECIATING THE EXISTENCE OF THESE RISKS, I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES, and assume full responsibility for my participation.

2. RELEASE, HOLD HARMLESS & INDEMNIFICATION

In consideration for allowing me to participate, I:

(a) release, discharge, and forever hold harmless MapleNet Catchball League from any and all liability for damages or loss arising as a result of the Risks of participation in or in connection with the Season Kickoff and related activities;

(b) waive any right to sue MapleNet Catchball League in respect of all causes of action (including for injuries or illness caused by my own negligence), claims, demands, damages, or losses of any kind that may arise as a result of the Risks, including without limitation the right to make a third-party claim against the Organization arising from the same; and

(c) freely assume all risks associated with the Risks, anything incidental to the Risks, which may arise as a result of my participation.

YOU ARE GIVING UP LEGAL RIGHTS TO ANY AND ALL FUTURE CLAIMS AGAINST THE ORGANIZATION.

I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, hereby to the greatest extent permitted by law, RELEASE, HOLD HARMLESS AND INDEMNIFY MapleNet Catchball League and its officers, directors, officials, agents, coaches, attorneys, volunteers, employees, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event (collectively "the Released Parties") from all liability, and all recourses, proceedings, claims, and causes of action of any kind whatsoever, present or in the future, in respect of any and all personal injuries or property losses which I may suffer arising out of or connected with travelling to and from, or my preparation for, or participation in the Season Kickoff or related Activities, notwithstanding that such injuries or losses may have been caused solely or partly by the active or passive negligence or breach of duty of the Released Parties or any of their directors, officers, employees, volunteers, sponsors, or agents.

I also recognize and agree that the Released Parties assume no responsibility for any liability, damage, or injury that I might sustain due to the intentional, unintentional, or negligent acts or omissions of any other person or organization. I nevertheless freely and voluntarily assume all the aforesaid risks and hazards, and my participation shall be entirely at my own risk.

3. FITNESS & MEDICAL

I certify that I am physically, emotionally, and mentally fit and have not been advised otherwise by a qualified medical professional. I willingly agree to comply with the stated and customary terms and conditions for participation. If I observe any unusual significant hazard during my presence or participation, I will immediately remove myself and bring such to the attention of the nearest organizer representative.

I certify that I am not under the influence of any narcotic, alcohol, or other drug that may impair my understanding or judgment, and that I will not at any time during the event participate under the influence of any such substance.

I understand that MapleNet Catchball League does not undertake to provide health, accident, disability, hospitalization, personal property, or other insurance for participants. I affirm that I have appropriate medical insurance coverage in the event medical attention is needed.

I hereby consent to receive emergency medical treatment that may be deemed advisable by a qualified medical professional in the event of injury, accident, and/or illness during the event or related activities.

Governing Law: This Agreement shall be construed, interpreted, and enforced in accordance with the laws of the Province of Ontario, Canada.

Severability: If any provision of this Agreement is determined by a court of competent jurisdiction to be illegal, invalid, or unenforceable, it will be ineffective only to the extent of its illegality, invalidity, or unenforceability without affecting the validity or enforceability of the remaining provisions.

I HAVE READ THIS WAIVER AND RELEASE OF LIABILITY AGREEMENT, AM OF SOUND MENTAL CAPABILITY, OF THE AGE OF LEGAL CONSENT, AND FULLY UNDERSTAND ITS TERMS. I UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY AGREEING TO IT, AND DO SO FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, UNDUE INFLUENCE OR RESERVATION. I INTEND MY AGREEMENT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.
